What Rights Do Foreign Workers Have in Romania – 2025 Overview

Your Rights as a Foreign Worker in Romania – 2025

As a foreign worker in Romania, you are protected by Romanian labor laws. Regardless of your nationality, if you have a legal work permit and residence permit, your rights must be respected by the employer — just like for any Romanian citizen.

1. Legal Employment Contract

You must receive a written contract in a language you understand before you start work. It must include your salary, working hours, job responsibilities, and termination conditions. The contract must be registered with the Romanian labor authority (ITM).

2. Minimum Salary & Overtime Pay

The gross minimum wage in Romania is updated every year. In 2025, the minimum net salary is around €600/month. If you work overtime or during weekends/holidays, the employer must pay extra according to the law.

3. Safe Working Conditions

Your employer must ensure safety at work. You have the right to receive training, protective equipment, and a clean, hazard-free environment. Accidents at work must be reported and covered by insurance.

4. Health Insurance & Social Benefits

As a legal employee, you are automatically enrolled in Romania’s national health insurance system (CNAS). This includes access to doctors, emergency services, and basic hospitalization. You also contribute to pensions and unemployment insurance.

5. Paid Leave and Holidays

  • Annual leave: At least 20 paid days per year
  • National holidays: 15 legal non-working days (e.g. New Year, Easter, Labour Day)
  • Sick leave: Covered partially by the employer and health system

6. Changing Employers

You cannot work for another employer unless a new work permit is issued. Leaving your current employer without notice may result in losing your legal status. Always discuss with immigration officers before changing jobs.

7. Protection Against Abuse

If you face threats, exploitation, or unpaid wages, you can file a complaint with ITM or the immigration authority (IGI). You have the right to legal help and, in some cases, protection against deportation.
